This amicus brief was written by NCLC, formatted and filed by EPIC, and co-signed by US PIRG, CFA and Public Knowledge, is in support of the FCC’s December 2023 regulations (pursuant to 47 CFR 64.1200(f)(9)) strengthening requirements for prior express consent for prerecorded telemarketing calls. Specifically, the new regulation requires one-to-one consent for these calls, closing what is known as the “lead generation loophole.”
