Hodges v. NewRez, LLC d/b/a Shellpoint Mortgage Servicing and The Bank of New York Mellon, 1:25-cv-10147 (D. Mass.)

The case seeks classwide relief against mortgage servicer NewRez, LLC, and loan holder Bank of New York Mellon for their mishandling of “zombie” second mortgages. The complaint alleges that the defendants failed, as a matter of systematic internal policy, to send billing statements to borrowers whose second mortgages were discharged in bankruptcy. Then, years later—in Ms. Hodges’s case, after more than a decade of hearing nothing about these loans—the defendants threatened foreclosure if the homeowners failed to pay tens of thousands of dollars in fees and purportedly past-due interest. The complaint alleges that these practices are prohibited by state and federal law and seeks relief for all homeowners placed in this situation by defendants’ conduct.
